The deal between you and Whisker Friskers.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf. The Service is not directed to children under 13, and we will delete any account we learn belongs to someone under 13. You must provide accurate information, keep your account credentials secure, and not share or transfer your account. One account per person.

2. What the Service is — and is not

Whisker Friskers is a community tool for logging stray and community cat sightings, coordinating Trap–Neuter–Return with other caretakers, and finding local rescue organizations, with an optional badge and trading card layer on top.

The Service is not veterinary advice, not an emergency service, and not a rescue dispatch. Nothing in the app is a substitute for a licensed veterinarian or for animal control. In an animal emergency, call a veterinarian or animal control — Louisiana SPCA: 504-368-5191. If a person is in danger, call 911.

The organizations listed in the Service are independent. Whisker Friskers is not affiliated with, endorsed by, or an agent of any of them, and we do not vouch for, supervise, or take responsibility for their services. The “Louisiana Feline Foundation” is a fictional in-app rank and badge name; it is not a real charity and receives no funds.

3. No money. No donations. No cash value.

Whisker Friskers does not collect, hold, process, or forward money. The Service contains no donation, tipping, fundraising, payment, or money-transmission feature of any kind, and we never solicit or accept charitable funds on behalf of any organization. Where the Service links to an organization’s donation page, that link opens the organization’s own website in your device’s browser; any contribution you make is solely between you and that organization, subject to their terms, and we receive no part of it, no commission, and no information about it.

Badges, points, cards, ranks, and vouchers have no cash value. They are a revocable, non-transferable license to a display feature inside the app. They are not property, currency, securities, or a store of value; they cannot be purchased, sold, traded for money, redeemed, exchanged for goods or services, or transferred outside the Service; and we may modify, reset, devalue, or discontinue them at any time, including on account termination, with no compensation owed.

4. Prohibited conduct

You agree not to do any of the following, and not to help or encourage anyone else to:

• Post, share, or promote animal cruelty, abuse, neglect, baiting, fighting, poisoning, or harm to any animal — including instructions, threats, or content that glorifies it.
• Harass, bully, threaten, stalk, intimidate, or incite violence against any person.
• Post hate speech or attack people based on race, ethnicity, national origin, religion, disability, age, sex, gender identity, or sexual orientation.
• Post sexual, pornographic, or sexually suggestive content, or any content sexualizing minors (which we report to the authorities).
• Dox anyone: publish a person’s home address, phone number, workplace, or other private information without their consent.
• Publish exact colony, feeding-station, trap, or shelter locations, or otherwise defeat location fuzzing to expose cats to harm.
• Submit fake sightings, staged photos, or knowingly false reports, or manipulate badges, points, cards, or leaderboards.
• Interfere with another caretaker’s colony, traps, feeding stations, or TNR work, or remove, relocate, or release trapped cats without the trapper’s knowledge.
• Spam, advertise, solicit, recruit, or run commercial animal sales, breeding, or rehoming-for-profit schemes.
• Solicit donations, payments, or funds from other users through the Service, or impersonate a charity or rescue organization.
• Impersonate any person, organization, or Whisker Friskers staff, or misrepresent your affiliation with a rescue.
• Upload malware, scrape or bulk-collect data, reverse engineer the app, bypass rate limits or security controls, or use bots or automated access.
• Evade a block, suspension, or ban, including by creating a new account.
• Break any applicable law, or violate anyone’s intellectual property or privacy rights.

5. Your content and the license you give us

You keep ownership of everything you post — photos, sightings, comments, messages, and profile information (“Your Content”). You are responsible for it, and you represent that you have the rights to post it and that it does not violate these Terms or anyone else’s rights.

You grant Whisker Friskers a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt (for example resizing images and fuzzing sighting coordinates), publish, and display Your Content solely in order to operate, moderate, secure, support, and promote the Service. This license ends when you delete Your Content or your account, except that: copies may persist in backups on their normal rotation for up to 30 days; content you sent to other users may remain in their message threads; content retained for safety and legal reasons is kept as described in the Privacy Policy; and de-identified, fuzzed sighting data may remain part of the community colony history.

We do not sell Your Content and we do not use it to train artificial intelligence or machine learning models, nor do we license it to others for that purpose.

The Service itself — the app, this website, our name, logo, artwork, badge and card designs, and code — belongs to WHISKER FRISKERS, L.L.C. and is protected by intellectual property law. You get a personal, revocable, non-transferable, non-sublicensable license to use it for its intended purpose, and nothing more.

6. Moderation, suspension, and permanent bans

We moderate. Content is screened by automated filtering before it becomes visible; anything flagged is held for human review rather than published. Every post, comment, photo, profile, and message has a one-tap Report control, and we act on reports as soon as possible and always within 24 hours. You can block any user immediately from their profile.

We may, at our discretion and without prior notice, remove or hide content, limit visibility, revoke badges and cards, restrict features, suspend an account, or permanently ban a user and refuse all future service. Serious violations — animal cruelty, sexual content involving minors, credible threats, doxxing, exposing colony locations, or ban evasion — result in immediate permanent termination on the first offense, and we may report them to law enforcement or animal welfare authorities. Terminated users may not create a new account. You may appeal a decision by emailing topher@whiskerfriskers.com; we read every appeal, and our decision after review is final.

You can stop at any time by deleting your account: Profile → Settings → Delete Account.

7. Copyright complaints (DMCA)

We respect copyright and we respond to valid notices under the Digital Millennium Copyright Act. If you believe content on the Service infringes your copyright, send a written notice to our designated agent that includes all of the following:

1. Your physical or electronic signature.
2. Identification of the copyrighted work you claim has been infringed.
3. Identification of the material you claim is infringing, with enough detail for us to locate it — a screenshot, username, and the date and time of the post is ideal.
4. Your name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

We remove or disable material that is the subject of a valid notice, and we notify the user who posted it. If you believe your content was removed by mistake or misidentification, you may send a counter-notice to the same agent containing your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you have a good-faith belief the removal was a mistake or misidentification, your contact information, and your consent to the jurisdiction of the federal court for the district in which you live (or the Eastern District of Louisiana if you are outside the United States). We may restore the material after 10 to 14 business days unless the complaining party notifies us that it has filed a court action.

Knowingly filing a false notice or counter-notice can make you liable for damages. Accounts that repeatedly infringe copyright are terminated.

8. Other users, and the real world

Whisker Friskers connects you with strangers and may lead you to meet them, handle animals, and use traps. You do all of that at your own risk and on your own judgment. We do not screen or background-check users, we do not supervise TNR activity, and we are not responsible for the conduct of any user or organization, online or off. Use common sense: meet in public, follow the law and the guidance of licensed clinics, and never handle an animal you are not equipped to handle.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WHISKER FRISKERS DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that content posted by users is accurate, that moderation will catch everything, or that any sighting, colony, or organization information is complete or current. This is a beta product and it will have bugs. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WHISKER FRISKERS, L.L.C. AND ITS MEMBERS, EMPLOYEES, AND VOLUNTEERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR ANIMAL OR PERSONAL INJURY ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, THE CONDUCT OF ANY USER OR THIRD PARTY, ANY MEETING OR TNR ACTIVITY, OR ANY CONTENT ON THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICH FOR A FREE SERVICE IS ZERO, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow these limitations, so they may not fully apply to you. You agree to indemnify and hold Whisker Friskers harmless from claims arising out of Your Content or your breach of these Terms.

11. Governing law and venue

These Terms are governed by the laws of the State of Louisiana, without regard to its conflict-of-laws rules. Any dispute that is not resolved informally must be brought exclusively in the state or federal courts located in Orleans Parish, Louisiana, and you and we consent to the personal jurisdiction of those courts. Nothing here deprives you of the protection of mandatory consumer law where you live. If any provision of these Terms is held unenforceable, the rest remains in effect.

12. Changes to these Terms

We may update these Terms. We will change the “Last updated” date and, for material changes, notify you in the app or by email before they take effect. Continuing to use the Service after that means you accept the updated Terms.

13. Apple App Store terms

The following applies to the Whisker Friskers: NOLA Crescent Kitties application obtained through Apple’s App Store or TestFlight. These Terms supplement, and are in addition to, Apple’s Licensed Application End User License Agreement.

1. Acknowledgement. These Terms are between you and WHISKER FRISKERS, L.L.C. only, and not with Apple Inc. (“Apple”). Whisker Friskers, not Apple, is solely responsible for the app and its content.
2. Scope of license. The license granted to you for the app is a limited, non-transferable license to use the app on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
3. Maintenance and support. Whisker Friskers is solely responsible for providing any maintenance and support services for the app, as specified in these Terms or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services for the app. Contact us at topher@whiskerfriskers.com.
4. Warranty. Whisker Friskers is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you (the app is free of charge, so the purchase price is zero); to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Whisker Friskers’ sole responsibility.
5. Product claims. Whisker Friskers, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including but not limited to product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual property claims. In the event of any third-party claim that the app or your possession and use of the app infringes that third party’s intellectual property rights, Whisker Friskers, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.
7. Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-party terms of agreement. You must comply with any applicable third-party terms of agreement when using the app.
10. Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
